DesignsCAD.com, operated by M&T International Inc. (doing business as “DesignsCAD”), respects the intellectual property rights of others and expects our users and vendors to do the same. This policy describes our procedures for handling copyright infringement claims under the Digital Millennium Copyright Act (DMCA). In this policy, “DesignsCAD”, “we”, and “our” refer to M&T International Inc.
1. Overview
If you are a copyright owner or authorized agent and you believe material on DesignsCAD infringes your copyright, you may submit a DMCA notice to our Designated Agent (contact details at the bottom of this page).
If content you uploaded has been removed following a DMCA notice and you believe the removal was a mistake, you may submit a counter-notice.
2. Reporting Copyright Infringement
To report copyright infringement, send a written notice to our Designated Agent containing all of the following:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the allegedly infringing material, including its specific location on DesignsCAD (URL), with enough detail to allow us to find and verify it.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Incomplete notices may result in delays or may be disregarded.
3. Our Response to a Valid Notice
Upon receiving a valid DMCA notice, it is DesignsCAD’s policy to:
- Remove or disable access to the allegedly infringing material.
- Notify the user who uploaded the material that it has been removed or disabled.
- Take appropriate action against repeat infringers, including account termination.
We reserve the right to share the contents of a DMCA notice with the user who posted the material, excluding sensitive personal information where lawful.
4. Counter-Notice Procedure
If your content has been removed and you believe the removal was a mistake or misidentification, you may submit a counter-notice to our Designated Agent containing all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed and the location at which it previously appeared.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, a statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the US, any district in which DesignsCAD is located), and that you will accept service of process from the party who sent the original notice.
Upon receiving a valid counter-notice, we may restore the removed content 10 to 14 business days later, unless the original complainant files a lawsuit seeking a court order against you.
5. Repeat Infringer Policy
DesignsCAD will terminate the accounts of users and vendors who are determined to be repeat infringers. We may also take additional action at our discretion, including removal of content, permanent bans, and reporting to relevant authorities.
6. False Claims
Submitting a false DMCA notice or counter-notice may result in legal liability for damages, costs, and attorneys’ fees. Please do not submit a notice unless you are certain of your claim.
