(doing business as “DesignsCAD”), a Canadian corporation located at Unit 1B – 3345 North Service Road, Burlington, Ontario, Canada L7N 3G2. In these Terms and Conditions (“Terms”), “DesignsCAD”, “we”, “our”, and “us” refer to M&T International Inc.
These Terms govern your access to and use of designscad.com and the services we provide. By creating an account, subscribing, or downloading any file, you agree to be bound by these Terms. If you do not accept these Terms, please do not use our services.
1. Eligibility
You must be at least 16 years old and legally capable of forming a binding contract to use DesignsCAD. By using the site you represent that you meet these requirements.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information at registration and to keep it current. One account per person. We may suspend or terminate accounts that violate these Terms.
3. Using the Library
DesignsCAD publishes CAD drawings, templates, and related files for use by design and engineering professionals. The material is intended for users who have the technical competence to evaluate and adapt it for their own purposes.
You are responsible for reviewing any downloaded file before using it in production work. DesignsCAD does not verify the technical accuracy or calculation control of published works and is not liable for damages resulting from their use.
Downloaded files may be used for your own personal, educational, or commercial projects. You may not redistribute, resell, or sublicense the files as standalone products.
4. Subscriptions and Auto-Renewal
DesignsCAD offers subscription plans that provide access to our library. By starting a subscription you authorize us to charge your payment method on a recurring basis (monthly, quarterly, or annually) until you cancel.
You can cancel your subscription at any time from your account settings. Cancellation stops future renewals but does not refund the current billing period. Renewal pricing is shown at checkout and in your account.
5. Refunds
All sales are final. No refunds will be issued, including for partial subscription periods or unused downloads, except where mandatory consumer protection laws in your jurisdiction require otherwise.
6. Vendors and Contributors
If you upload content to DesignsCAD as a vendor, you represent and warrant that:
- You own or have the necessary rights to the content you upload.
- The content does not infringe any third-party intellectual property, privacy, or publicity rights.
- The content does not contain viruses, malware, or unlawful material.
By uploading content, you grant DesignsCAD a worldwide, non-exclusive, royalty-free license to host, display, distribute, and promote your content through our services.
Commissions. Vendors earn 76% commission on each CAD drawing sold through DesignsCAD. Commissions are paid upon request once your account balance reaches a minimum of 0 USD. Payments are sent to the PayPal account on file in your seller profile within 48 hours of a valid payment request. To set or update your PayPal email, go to your seller profile. To request a payout, email [email protected] from the address associated with your account.
DesignsCAD reserves the right to remove any submission that violates these Terms, our policies, or applicable law.
7. Intellectual Property
All content on DesignsCAD, excluding user-submitted material, is the property of DesignsCAD or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of our site design, branding, or original content without permission.
DesignsCAD respects intellectual property rights. If you believe your copyright has been infringed, please see our DMCA Policy.
8. Prohibited Conduct
You agree not to:
- Use the service for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Scrape, mirror, or bulk-download files beyond normal personal use
- Upload malicious, misleading, or infringing content
- Impersonate any person or entity
9. Disclaimer of Warranties
The service is provided “as is” and “as available” without warranties of any kind, express or implied. DesignsCAD does not guarantee that the site will be uninterrupted, error-free, or free of viruses or other harmful components. Use of downloaded files is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, DesignsCAD will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the service shall be resolved in the courts located in Ontario, Canada, and you consent to the exclusive jurisdiction and venue of those courts, except where mandatory consumer protection laws in your jurisdiction require otherwise.
